1. License Grant

Wine-oh! is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, revocable license to use the Wine-oh! app on any Apple-branded device you own or control, in accordance with the Usage Rules set forth in the Apple App Store Terms of Service.

You may not:

• Distribute or make Wine-oh! available over a network.
• Reverse-engineer, decompile, modify, or create derivative works of any part of the app, except as expressly permitted by law.
• Transfer, sublicense, or sell the app to another party.

2. User Eligibility

By using the app, you confirm that you are:

• At least 21 years of age (or the legal drinking age in your jurisdiction).
• Not prohibited by law from using such services.

3. Data Collection and Use

We collect technical data and analytics to support product improvement, personalization, and support. This may include device type, OS version, crash logs, and usage patterns. We do not collect or store personally identifiable information without consent.

4. External Services & Integrations

Wine-oh! may provide access to third-party services, such as:

• Spotify and Apple Music APIs
• Restaurant wine list scans
• AI-driven recommendations (via third-party platforms like OpenAI)

Use of such services is at your own risk. We do not endorse or guarantee third-party content or services, and Wine-oh! is not responsible for their accuracy, availability, or data practices.

5. Subscription & Payment Terms

Wine-oh! offers both monthly and annual subscription plans, billed via your App Store account. You can manage or cancel your subscription through your device’s subscription settings. All purchases are final, and we do not offer refunds for unused time unless required by law.

Trial periods may be offered and will automatically convert to paid subscriptions unless canceled before the end of the trial.

6. Termination

This Agreement remains in effect until terminated by you or the Company. Your rights under this Agreement will terminate automatically if you violate any of its terms. Upon termination, you must cease all use of Wine-oh! and delete the app from your devices.

7. No Warranty

Wine-oh! is provided “as is” and “as available” without warranties of any kind. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The app will be uninterrupted or error-free.
• Any wine recommendation will match personal taste or health considerations.

8. Limitation of Liability

To the extent permitted by law, we will not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business interruption
• Any damage exceeding $50 in total liability

Some jurisdictions may not allow these limitations, so they may not apply to you.

9. Export Compliance

You may not use, export, or re-export the app in violation of U.S. export laws. You represent you are not located in a U.S.-sanctioned country or on any restricted list.

10. Governing Law

If you reside in the United States, this Agreement is governed by the laws of California, with venue in the courts of Santa Clara County, California. If you reside in the EU, Switzerland, Norway, or Iceland, your local laws and courts shall apply.

11. Updates & Modifications

We may update this Agreement at any time. Continued use of Wine-oh! after any update constitutes your acceptance of the new terms. Material changes will be notified via the app or email (if provided).
